Real Estate Contracts

We believe that a carefully negotiated and drafted real estate contract is the best way to protect your legal rights, and to minimize the possibility of a dispute resulting in litigation. We represent business and personal clients in diverse real estate matters, including contracts, purchase or sale of real estate, construction contracts, and renovation contracts for houses, co-op and condominium apartments and commercial premises. As a thoroughly experienced New York real estate lawyer, we are equipped to provide legal representation for businesses and individuals involved in real estate transactions, real estate contracts of any kind, mechanic’s liens, as well as real estate disputes, including real estate litigation, real estate arbitration, and real estate mediation.

You will appreciate the level of personal attention you will receive from Michael W. Goldstein, as well as the thoroughness and quality of legal representation.

We thoroughly and meticulously draft contractual terms with the goal of leaving nothing to chance. We believe that our approach affords our clients maximum protection against both foreseeable situations, as well as unlikely problems that may interfere with the smooth progress of a real estate transaction.

Real Estate Transactions

Michael W. Goldstein is a highly effective New York real estate lawyer. Our clients, whether first-time home buyers, experienced home buyers or sellers, or sophisticated real estate investors, can rely on our expertise as a successful New York real estate attorney, to navigate them through the maze of real estate contracts, mortgage or co-op loans, co-op or condominium Offering Plans, managing agent’s requirements, co-op Board of Directors’ requirements or condominium Board of Mnagers’ requirements, title searches, restrictive covenants, easements, certificates of occupancy, title issues, estate transfers, surveys, encroachments, variations between surveys and current buildings and physical structures, and other issues involving real estate transactions in New York.

In our real estate transactions area of practice, we carefully draft all contracts and other documents, with the aim of addressing all issues that might reasonably arise in the transaction. We always aim to resolve potential issues before they become disputes that might derail a New York real estate transaction. We want our clients’ real estate transactions to be successfully consummated, and we do everything in our power to accomplish that goal.

Real Estate Litigation

We have been involved in real estate litigation in many types of cases, including:
•Shareholder Derivative Action against co-op corporations’ Boards of Directors involving claims of dissipation of corporate assets, and issues regarding the business judgment rule
•Lawsuit for Injunctions Against Adjacent Property Owners, and construction companies
•Lawsuit by Property Owners Against a Construction Company that fraudulently obtained title to the clients’ property under the guise of facilitating the financing of a demolition and major construction project

Time Limitations

There are strict time limitations that apply to New York lawsuits, including real estate litigation, and other types of New York litigation. The statute of limitations (time limit for commencing litigation) varies depending on the type of case, and in some instances, depending on the defendant being sued. Furthermore, many types of claims and lawsuits also have other time limitations (in addition to the statute of limitations), such as time limitations for filing a Notice of Claim, Notice of Intention to Make Claim, and other important documents.

Although our office is located in Manhattan, we represent clients in all counties of the City of New York, as well as Nassau, Suffolk, Westchester, Rockland, and upstate New York.  If it is inconvenient for a client to travel to our office, alternate arrangements can be made.
